Terms and Conditions

1. Agreement

By visiting, reading, playing, signing in, joining the Pulse, posting a contact message, voting, favoriting, or paying for Private Pulse, you agree to these Terms and to the Privacy Policy. If you do not agree, do not use the service. We may update these Terms by posting a new date on this page. Continued use after a change is acceptance of the new Terms.

2. Who may use this desk

You must be at least 13 years old. If you are under 18, you may use the public archive only with a parent or guardian’s consent. Private Pulse, accounts, votes, and Midnight Fist Lab are offered to people 18 or older, or to minors only with verifiable parental consent where required by law. You are responsible for the account you open and for keeping sign-in credentials secret.

3. The archive is fiction

Stories, series, field logs, games, visual-novel routes, World Desk traces, Midnight Fist Lab fighters, RIFTALITIES, and any “recovered file” framing are original fiction and artistic presentation. They are not news, medical advice, legal advice, investment advice, or a statement of fact about living people unless we expressly say so in a non-fiction note. Place names (including Billings, Blackpine, Neohaven, Point Pleasant) may be used atmospherically. Do not treat in-world instructions as instructions for the real world.

4. Accounts and reader tools

Sign-in may use Google, X, or other providers we enable. We do not promise uninterrupted access. Favorites, votes, Pulse signups, contact tickets, and memberships are conveniences. We may remove, reset, or refuse any of them if we reasonably believe they are abusive, automated, unlawful, or a threat to the service or other readers.

5. Private Pulse ($0.99 / month)

Private Pulse is an optional paid membership. Price is USD $0.99 per thirty-day period unless a later posted price replaces it. Member files are licensed to you personally for the active period: you may read them and receive them at the inbox address you give us. You may not republish, scrape, train models on, or resell them. Canceling stops renewal; access continues until the paid period ends unless we terminate for breach. We may change the roster of member files. We do not guarantee a set number of files in any month. Fees already paid are not refunded except where a statute requires a refund, or where we cancel the membership for a reason other than your breach.

If card billing is not yet attached on a particular deploy, any complimentary or preview access we grant does not waive the right to charge the posted price later and does not create a permanent license.

6. Your messages and votes

If you send a contact message, you grant Plot-Pulse a worldwide, royalty-free, perpetual license to store, read, and use that message to reply, to run the desk, and to defend our rights. You represent that the message is yours to send and is not unlawful. Votes and favorites are not public endorsements by us. Do not submit anyone’s personal data except your own, or data you have a right to share.

7. Intellectual property

All text, characters, series, stamps, games, visual-novel scenes, Midnight Fist Lab roster and arenas, trademarks, and site design are owned by Christopher Smith / Plot-Pulse or used under license. You receive a limited, revocable, non-exclusive, non-transferable license to access the public archive for personal, non-commercial reading and play. You may share a link to a public page. You may not copy the stories, scrape the archive, train a model on the files, frame the site, or sell access without prior written permission.

Fan art and short quotation for criticism or review is welcome when it is lawful fair use and clearly credits Plot-Pulse. It does not transfer ownership and does not let you register a conflicting mark.

8. Midnight Fist Lab (beta)

Midnight Fist Lab is an unfinished, freely offered combat prototype (current public build: BETA 1.01.001.1). It is provided “as is.” Progress saved in the browser may be lost. Difficulty, roster, unlocks, and maps may change or reset. RIFTALITIES and other effects can flash the screen. If you have photosensitive epilepsy or a similar condition, do not play, or disable finishers and look away from flashes. You play at your own risk. We are not liable for injury, lost save data, or device damage arising from play except to the extent a law forbids that limit.

9. Ads and underwriters

First-party “underwriter” placements are part of the site and appear for every visitor of a given page. The live domain also publishes an ads.txt file so Google AdSense, Jetpack, and listed authorized sellers can lawfully offer inventory when that stack is enabled. Third-party ads, if shown, are the responsibility of those networks. Clicking an off-site link leaves our terms.

10. Acceptable use

You will not: attack or overload the service; probe it without permission; impersonate the operator or a character in a way meant to defraud; harvest emails; post malware; use the contact desk to threaten, harass, or spam; automate votes; circumvent the Private Pulse gate; or use the service to break the law. We may block an address, account, or network without notice.

11. Copyright complaints (DMCA)

If you believe material on Plot-Pulse infringes your copyright, send a notice that meets 17 U.S.C. § 512(c)(3) through the contact form with topic “Legal / takedown,” or write the operator at the public X account listed on the site. Include: your signature, the work claimed, the URL of the material, your contact information, a good-faith statement, and a statement under penalty of perjury that you are the owner or authorized agent. We may remove material and, for repeat infringement, terminate accounts.

12. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, PLOT-PULSE AND CHRISTOPHER SMITH DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. We do not warrant that the archive is error-free, that games will be fair or available, that email will arrive, or that third-party sign-in or payment providers will work.

13. Limit of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, PLOT-PULSE AND CHRISTOPHER SMITH WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, OR LOST GOODWILL, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR PRIVATE PULSE IN THE THREE MONTHS BEFORE THE CLAIM OR (B) TEN U.S. DOLLARS ($10). Some places do not allow these limits; in those places the limit is the maximum the law allows. Nothing here limits liability that cannot be limited, including liability for fraud or for death or personal injury caused by our negligence where that bar is forbidden.

14. Indemnity

You will defend and indemnify Christopher Smith and Plot-Pulse against claims, damages, and reasonable legal fees arising from your misuse of the service, your messages, your violation of these Terms, or your infringement of someone else’s rights.

15. Termination

You may stop using the service at any time and may cancel Private Pulse as described above. We may suspend or end access immediately if you breach these Terms or if we shut the desk down. Sections that by nature should survive (including 3, 6, 7, 12–14, 16–17) survive termination.

16. Governing law and venue

These Terms are governed by the laws of the State of Montana, USA, without regard to conflict-of-law rules. Exclusive venue for any dispute that is not resolved informally is the state or federal courts sitting in Yellowstone County, Montana, and you consent to personal jurisdiction there. If a court finds a clause unenforceable, the rest remains in force.

17. Entire agreement

These Terms and the Privacy Policy are the entire agreement between you and Plot-Pulse about the service. They supersede prior or contemporaneous terms for this desk. A waiver of one breach is not a waiver of the next. You may not assign these Terms. We may assign them in connection with a sale of the project. Headings are for reading, not for construction.
